New Foreign Trade Regulations in December

1. Starting from December 1st, China unilaterally grants Laos a tax exemption for 97% of goods

According to the announcement of the Customs Tariff Commission of the State Council, in accordance with my country’s commitment to grant zero-tariff treatment to 97% of the least developed countries’ tax items, and in accordance with the exchange of letters between my country and the Lao People’s Democratic Republic, starting from December 1, 2020, the For products of 97% taxable items in the Republic, the applicable tax rate is a preferential tax rate of zero.

There are 8,256 tax items in Laos enjoying China's duty-free treatment. These include 5,161 tax items marked as "beneficiary country LD" in the preferential tax rate column, 2911 tax items of "beneficiary country 1LD1", and 184 tax items of "beneficiary country 2LD2".

2. Implementation of new highway inbound and outbound transportation and cargo manifest management from December 1st

The General Administration of Customs issued Announcement No. 113 of 2020 on October 12, adjusting matters related to the management of highway inbound and outbound means of transport and cargo manifests.

Relevant enterprises are required to strictly follow the relevant regulations, as well as the requirements of this announcement regarding the data items and filling specifications of the electronic data of road inbound and outbound transportation vehicles and freight manifests, and declare to the customs to transmit the electronic data of road inbound and outbound transportation vehicles and freight manifests.

The announcement will come into effect on December 1, 2020.

3. Issue the first batch of permitted imports of crude oil for non-state trade in 2021 before December 31

4. Allocate 2021 cargo export quotas before December 15

The Ministry of Commerce Announcement No. 49 of 2020 announced the total amount of export quotas for goods (2021) and related matters concerning quota management.

In 2021, the export quotas for licorice and licorice products, artificially planted ephedra for medicinal materials, live pigs (to Hong Kong and Macau), live cattle (to Hong Kong and Macau), live chickens (to Hong Kong), sawn timber, rush and rush products are respectively 4.6 million kilograms, 1.2 million kilograms, 1,130,400 heads, 28,000 heads, 3 million pieces, 100,000 cubic meters, 21 million kilograms.

The Ministry of Commerce will review the accepted applications in accordance with the law and allocate quotas to eligible applicants before December 15, 2020.

5. From December 15th, applications will be accepted and 2021 tariff quotas for fertilizer imports will be issued

The Ministry of Commerce Announcement No. 52 of 2020 announced the total amount of fertilizer import tariff quotas, allocation principles and related procedures in 2021.

In 2021, the total import tariff quota of chemical fertilizers will be 13.65 million tons. Among them, 3.3 million tons of urea; 6.9 million tons of diammonium phosphate; 3.45 million tons of compound fertilizer.

Starting from December 15, 2020, the tariff quota management agency will accept applications for fertilizer import tariff quotas and issue the 2021 "Fertilizer Import Tariff Quota Certificate."

6. Hainan Free Trade Port’s first list of "zero-tariff" commodities will take effect on December 1st

On November 11, the Ministry of Finance, the General Administration of Customs, and the State Administration of Taxation jointly issued the "Notice on the "Zero Tariff" Policy for Raw and Auxiliary Materials of Hainan Free Trade Port."

A total of 169 8-digit tariff items, including coconut and other agricultural products, coal and other resource products, xylene and other chemicals, optical fiber preforms, and other raw materials, as well as aircraft, other aircraft and ship repair parts, have been released. List of accessories.

This is the first "zero-tariff" product list released by the Hainan Free Trade Port. It will be implemented on December 1, 2020. The positive list management of "zero-tariff" raw materials will be implemented. The content of the list will be dynamically adjusted by the Ministry of Finance in conjunction with relevant departments in accordance with the actual needs and regulatory conditions of Hainan.

7. The "Eurasian Economic Union and China Customs Information Exchange Agreement" officially came into effect

According to a recent announcement by the Eurasian Economic Commission, the "Eurasian Economic Union and China’s Agreement on the Exchange of Information on International Transportation of Goods and Vehicles" has officially entered into force.

The Central Customs of the member states of the Union and the General Administration of Customs of China will act as the authorized implementation units for information exchange. The "Agreement" provides for the implementation of information exchange in stages, and both parties will sign a special protocol to clarify specific implementation conditions.

8. The first "Export Control Law" comes into force

The "Export Control Law of the People's Republic of China" (hereinafter referred to as the "Export Control Law") shall come into force on December 1, 2020. This marks the first special law in the field of export control in our country.

The Export Control Law has five chapters and 49 articles, including general rules, control policies, control lists and control measures, supervision and management, legal responsibilities and supplementary provisions. It mainly stipulates the scope of export control, export control list, temporary control and comprehensive control, export business qualification and export licensing system, end-user and end-use management, extraterritorial application and reciprocal measures, etc.
